NYC Solar & Green Roof Law: What It Entails And How To Comply.

Local Laws 92 and 94 of 2019 require most new construction, roof enlargements, and full roof replacements in New York City to dedicate their "Sustainable Roofing Zone" to solar photovoltaic panels, a green roof, or a combination of both. Enacted alongside Local Law 97 as part of the Climate Mobilization Act, these laws took effect November 15, 2019, and apply citywide regardless of a building's size.

What Triggers LL92 & LL94 Compliance?

1. New building construction.

2. Roof enlargements that increase the roof’s horizontal square footage.

3. Full or substantial replacement of the roof deck or roof assembly.

What Does The Sustainable Roofing Zone Require?

1. Roofs with 200 square feet or more of eligible area (100 square feet or more for residential buildings of five stories or fewer) must cover the entire Sustainable Roofing Zone in solar panels, a green roof, or a combination of both.

2. Smaller roof areas must install either a full 4kW solar system or a full green roof; combining the two is not permitted below the threshold.

3. Roof slopes greater than 2:12 may only use solar photovoltaic panels.

What Are The LL92 & LL94 Exceptions?

1. Fire access pathways, mechanical equipment, water towers, and parapets.

2. Required stormwater management infrastructure.

3. Existing recreational space on the roof.

4. Simple roof repairs that do not constitute a full replacement.

Effective Date & Filing

Local Laws 92 and 94 took effect on November 15, 2019, and apply to covered projects citywide, regardless of building size.

Filing: Compliance is documented through a Local Laws 92/94 of 2019 Solar and Green Roof Systems filing submitted to the Department of Buildings, prepared by a registered design professional and, where solar is installed, a licensed electrician.

Tax Incentives: Property owners who install a qualifying solar or green roof system may be eligible for a real property tax abatement.
